URFA - A lawsuit was filed against 96-year-old Aliye Yavaşsu for 'insulting the president', who has a report proving that she is lacking criminal capacity due to old age.
A law suit was filed against 96-year-old Aliye Yabansu who lives in a tiny container in the Siverek district of Urfa for 'insulting the president'. A criminal complaint was filed against Yabansu who has a report proving that she lacks criminal capacity due to old age on grounds of a video of her taken without her knowladge. The indictment prepared by Urfa Chief Public Prosecutor's Office demands that 'security measures due to mental illness' should be applied for Yabancu whom the prosecutor office claims that she has used words that could offend the honour and dignity of the president.
A BEDRIDDEN PATIENT
During the final hearing held at the Siverek 1st Criminal Court of First Instance on December 1, 2020, attorney of Yabansu, Celil Tanış who stated that his client is a 96-year-old bedridden patient, said: "It is impossible to determine who my client was talking about in the video in question. She is not addressing anyone or giving any names" and requested his client to be acquitted. The prosecution, in its opinion on the merits, stated that Yabansu submitted a report from Mehmet Akif Inan Training and Research Hospital that she lacks criminal capacity due to old age and demanded "the implementation of security measures specific to mentally ill patients".
The court decided that Yabansu had no criminal responsibility and she must be admitted to a hospital until her 'danger to society disappears or decreases significantly'. Even though the court spesifically underlined that she should be admitted to the closest hospital, Siverek Chief Public Prosecutor's Ofice decided Yabansu to be admitted to a hospital in Kayseri which is 9 hours from her home.
'SHE MIGHT NOT MAKE IT TO THE HOSPITAL'
Yabansu's attorney Tanış objected to the decision but the objection was rejected. Tanış said: "She is unable to meet her basic needs. It is cruel to send a 96-year-old bedridden woman to a 9 hour drive that it could be considered torture. My client is too old and too sick, waiting to die in her own bed. Sending her off to a city she doesn't know to be examined by people she doesn't know is a death sentence. She might not even make it to that hospital" and requested that the security measures to be lifted.
