ÊLIH - The 17-year-old boy, whose head was broken in three places by the police, was not subjected to a forensic examination at the hospital where he was taken. It was decided to arrest him without a report, upon the request of the prosecutor's office. When the prison he was taken to did not accept the child without a forensic examination report, a report was hastily prepared.

17-year-old Suleyman C, who attended the celebrations held on April 4 after the People's Equality and Democracy Party (DEM Party) won the election in Êlih (Batman), was tortured and detained after the celebration. A report was not prepared for Suleyman C, who was hit on the head with a gun butt and his head was broken in 3 places after being detained by the police on the day of the incident, at Batman Training and Research Hospital, where he was taken for forensic examination. After his report was not submitted without stating a reason, Suleyman C was referred first to the Batman Provincial Police Department and then to the Batman Chief Public Prosecutor's Office. Although there was no forensic examination report, the prosecutor's office continued the proceedings against Suleyman C and referred him to the Batman Criminal Court of Peace with a request for arrest. The Criminal Judge of Peace decided to arrest Suleyman C without a forensic examination report in the file.

A REPORT WAS RECEIVED HASTILY

A forensic examination report was hastily prepared after the administration of the Batman Type M Closed Prison, where he was referred, stated that they would not accept the tortured Suleyman C without a forensic examination report.

Explaining what his client went through, Suleyman C's lawyer Yunus Bagis said that a report was hastily issued from Iluh State Hospital after the prison administration informed him that they could not take his client to prison without a report of assault. Noting that the police, prosecutor's office and judge's actions without a report are against the law, Bagis said that they will file a criminal complaint against the police officers who assaulted them, the doctors who did not submit the report, the prosecutor's office that requested arrest without a report, and the court that issued an arrest order.

CHAIN OF UNLAWFULNESS

Noting that his client arrested unlawfully without a single concrete reason, Bagis continued as follows: "The reason for the arrest was the allegation of 'committing a crime on behalf of the terror organization, although not being a member of the organization'. As it is known, this article was canceled. It was put into effect again with the 8th judicial package. He was tortured by being thrown into a plainclothes police vehicle during the dispersal. This happened while he was going home while he was not involved in any protest or activity. There is no attempt to attack public officials or property in the file. There are no images included in the file. It was also examined by the prosecutor's office. There is not a single piece of evidence. However, he was arrested unlawfully. This unlawfulness has become a chain of unlawfulness.”
