DİYARBAKIR - It has been learned that an investigation has been launched which was resuled in non-prosecution because of the expression 'Kurdistan' used by the imprisoned DTK Co-chair Leyla Güven.
It has been learned that an investigation has been launched by the Bingöl Chief Public Prosecutor's Office against Democratic Society Congress (DTK) Co-chair Leyla Güven for the expression "Kurdistan" she used on a radio show in Bingöl on November 30, 2020.
Güven said, "I came to Bingöl, we have a public meeting in Bingöl tomorrow, yes, we have been holding these public meetings for days. In addition, we continue to work hard in Kurdistan, we hold public meetings. We came to say hello to the people of Bingöl."
Güven, whose statement was taken within the scope of the investigation launched on the accusation of "propagandising for a terrorist organization", said that she used the term "Kurdistan" referring to a geographical region.
Completing the investigation, the Chief Public Prosecutor's Office decided not to prosecute on the grounds that the word "Kurdistan" used alone did not constitute the crime of "propagandising for a terrorist organization".
Referring to two separate decisions taken by the Court of Cassation in 2019 and 2021 on this issue, Chief Prosecutor's Office said, "In similar jurisprudence, saying, using the phrase 'Kurdistan', shouting the slogan, printing it as a brochure alone does not constitute the crime of propagandasing for an organization within the scope of freedom of expression" and decided not to prosecute.
